Testosterone Lawsuits Rising; Consolidation Possible
Following a request filed in March 2014 to consolidate all AndroGel lawsuits into a multidistrict litigation, a second motion has been filed with the U.S. Judicial Panel on Multidistrict Litigation requesting that all testosterone lawsuits be centralized before one judge as a consolidated, single proceeding.
Currently, there are more than 50 product liability cases filed in U.S. District Courts throughout the U.S. on behalf of men who have reportedly suffered from blood clot, stroke, heart attack or other injury that was allegedly caused by testosterone treatment therapies. While most of these testosterone lawsuits involve AndroGel, the most widely used treatment, other testosterone lawsuits have been filed by men who used other types of testosterone therapies, such as Androderm, Axiron and Testim that were sold in the form of patches, creams and gels.
A Motion to Transfer was filed on April 11, 2014 by a plaintiff and his wife, asking that one proceeding be established for claims involving each manufacturer of testosterone therapies. The plaintiff indicated that his injury occurred following use of both Testim and Androgel, which are two different products manufactured by different companies.
This request comes a little more than two weeks after another group of plaintiffs filed a motion to centralize all AndroGel claims as part of an MDL, which would be limited to claims brought by users of that particular product. Filed by the U.S. JPML in April 2014, a Notice of Hearing Session reported that oral arguments on the motion to establish an MDL for AndroGel claims would be heard in Chicago on May 29, 2014. It is not yet clear whether the second motion recently filed to include all testosterone lawsuits will be heard at this time or whether that motion will be heard in July 2014 at a future session.
Out of the 50 testosterone claims currently pending, at least 37 cases involve injuries allegedly caused by AndroGel. However, all of the cases involve similar claims that the drug makers neglected to adequately warn about the risk of blood clots, strokes, heart attacks and death associated with testosterone treatment therapies.
